New Residency regulation for EU Citizens and their families: Residence for more than 3 months, new requirements according to the Royal Decree Law 16/2012 and the modification of the article 7 of the Royal Decree 240/2012 (Orden PRE/1490/2012, de 9 de Julio).
Basically the new residency regulation wants to guarantee the viability, in terms of cost, of the Spanish Public Health System. From now on, every applicant has to guarantee that he or she is the beneficiary of a Full Public or Private Health care Assistance and will have to show a proof of income too.
There are different scenarios:
1) When the applicant works for a company or works for someone else, it is necessary to show a declaration signed by the employer or a proper legal contract. In that case the document will be the proof of income and the guarantee of the medical coverage.
2) When the applicant is self-employed, he or she has to show his registration in the Social Security and Tax Office and the proof of payments. If instead of to join the Public Health System to have a private Insurance, copy of the contract in order to guarantee full coverage.
3) When the applicant does not work it has to be beneficiary of a Public or Private Health Insurance contracted in Spain or if it was contracted abroad with validity in Spain for full medical coverage. For example, a UK Pensioner who has full coverage in UK has to show the S1 provided by his Social Security Office. It will be also imperative to demonstrate a proof of income (pension) enough to support him/her and the family.
